Article 16 of the Decision on the Fee for Utility Equipping of Construction Land, Official Gazette of Montenegro, No. 048/20, prescribes reductions or reliefs on the fee for utility equipping of construction land.
The fee amount determined in accordance with this Decision is reduced for:
– objects addressing housing issues – by 50%;
– objects in the business zone – by 100%;
– open space on the plot designed for performing activities – by 50%;
– objects intended for new employment of more than 10 persons – by 20%;
– objects with installed solar panels in accordance with the revised main project of the solar system used for heating sanitary water, heating, and cooling space – by 100 euros per m2 of installed solar panel, up to a maximum of 50% of the calculated fee;
– conversion of a special and common part of a residential building into a business premises or business premises into a special or common part of a residential building – by 70%;
– attics in buildings with a net area of up to 200 m2 – by 50%; – attics in other buildings – by 10%;
– reconstruction or demolition of an existing object and construction of a new object within the existing dimensions if additional utility equipping is needed – by 50%, provided that the object is registered in the real estate cadastre, categorized by parts, and without registered encumbrances of “no permit” or “no construction notice”;
– reconstruction of objects in cultural-historical complexes or objects registered in the cultural heritage register – by 80%;
– for independent above-ground garage objects – by 80%;
– for above-ground garages within the building – 80%, where the reduction applies to parking spaces and internal communications;
– religious objects – by 80%;
For the reduction in the fee amount from paragraph 1 of this Article, the investor is obliged to submit the reviser’s statement confirming the fulfillment of the conditions for paying the reduced fee.
For the reduction in the fee from paragraph 1, item 1 of this Article, proof must be provided that the investor and members of their household do not own a residential building or unit within the territory of Montenegro, or do not own more than one-third of the total surface area of a residential building or unit in Montenegro, which is no larger than 99.00 m2, in the last (3) years from the date of the request for fee calculation and a declaration of the family household and the number of household members.
In the case of paragraph 1, item 5 of this Article, a refund of funds will be executed through an annex to the utility equipping fee contract, which is concluded at the request of the investor after the final report of the professional supervision, based on the statement of the special commission of the Municipality. If the investor has already obtained the right to a fee reduction under another basis from paragraph 1 of this Article through the main contract, a refund will be made in the amount of the difference between the reduction based on the installed solar panels and the reduction obtained from the main contract.
For the objects referred to in paragraph 1, item 6 of this Article, the calculation is made based on the real estate list, which the authority responsible for issuing the conversion decision submits to the local administration body responsible for determining the fee.
For the objects referred to in paragraph 1, item 9 of this Article, the reduction applies only to the net area of the existing object, and not to the newly constructed area, if there is any.
If the applicant does not submit evidence in accordance with Article 239, paragraphs 4 and 7 of the Law and the documents referred to in paragraph 2 of this Article, or if it is determined from the documents that the object does not meet the conditions under which the fee reduction was granted, the fee will be calculated in full.
The fee may represent the participation of the Municipality of Tuzi in a public-private partnership.
If the investor is entitled to a fee reduction based on multiple grounds from paragraph 1 of this Article, the reduction that is most favorable to the investor will be applied.
